01

Acceptance of the Terms

By using the App or related services, you confirm that you have read, understood, and agreed to these Terms and the Jetway Privacy Policy. If you do not agree, do not use the App or services.

If you use the service on behalf of an organization, you represent that you have authority to bind that organization. In that case, “you” includes the organization and its authorized users.

02

Description of the Service

Jetway is a network tool that uses local VPN configuration and relay infrastructure to provide features such as encrypted connections, smart or global routing, destination selection and status, DNS and TLS settings, local mappings, rewrite rules, scripts, local Footprint records, and subscription benefits.

Available functions, destinations, gateways, speeds, capacity, regions, plans, and benefits may vary by account, app version, device, storefront, network conditions, and remote configuration. We do not guarantee that any particular feature, destination, gateway, or capacity will always be available.

03

Eligibility and Account Security

You must be at least 17 years old and legally able to enter into these Terms. If applicable law requires consent from a parent or legal guardian, you may use the service only with that consent and supervision.

The App may use a device identifier to create or recover a service account and may assign a user identifier and access token. You are responsible for protecting your device, Apple account, service identifiers, and access token, and for activity conducted through them. If you suspect unauthorized use, report it through an available support channel.

You may not sell, rent, lend, transfer, or share your account, token, or subscription benefits except where expressly permitted by Apple Family Sharing, App Store rules, or applicable law.

04

Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the App on Apple-branded devices that you own or control, as permitted by the Apple Media Services Terms and Conditions, for personal use or authorized internal organizational use.

The App is licensed, not sold. Except where applicable law or an applicable open-source license expressly permits it, you may not copy, modify, rent, lease, sell, distribute, sublicense, reverse engineer, decompile, disassemble, extract source code from, bypass protections in, or create derivative works from the App or service.

05

Acceptable Use

You must comply with laws applicable to your location, your access to the service, and your selected destination. You are responsible for determining whether VPN or related network services are lawful where you use them.

You must not use the App or service to:

  • engage in unlawful conduct or infringe intellectual-property, privacy, or other rights;
  • distribute malware, attack or scan systems, intrude into accounts or networks, send spam, commit fraud, or obtain unauthorized access;
  • disrupt or overload the service, bypass security or capacity controls, or interfere with other users;
  • bypass subscription controls, falsify transactions, share access tokens improperly, or resell the service without authorization;
  • conduct activities prohibited by sanctions, export-control rules, or other applicable restrictions; or
  • create an unreasonable risk to the service, its providers, or others.

We may investigate suspected abuse and restrict, suspend, or terminate access when reasonably necessary.

06

Your Configurations and Responsibilities

The App may allow you to edit DNS and TLS settings, local mappings, rewrite rules, scripts, and configuration text. These settings can alter requests, certificate validation, name resolution, and displayed or delivered content.

You are responsible for configurations and scripts that you add, import, run, or share, and for having the rights needed to use them. Incorrect or untrusted configurations may cause connection failures, data leakage, routing to the wrong destination, service unavailability, or device-security risks. Use trusted sources and keep appropriate backups.

You are also responsible for third-party content that you access, upload, download, or transmit. The service does not grant you rights to that content.

07

Availability, Changes, and Maintenance

The service may be interrupted, slowed, or unavailable because of maintenance, congestion, capacity limits, third-party systems, security events, legal requirements, or events beyond our reasonable control. We may add, change, limit, suspend, or discontinue features or services and, where reasonable, notify you of materially adverse changes.

Updates may be required to continue using the App, and older versions or features may stop working. You are responsible for device, internet, mobile-carrier, and other third-party costs associated with using the service.

08

Subscriptions, Billing, Renewal, and Refunds

Paid plans are offered through the App Store. The product, price, currency, billing period, trial, offer, and included benefits shown in the purchase confirmation govern your order.

Payment is charged to your Apple account. We do not receive complete payment-card information.

Subscriptions renew automatically unless you cancel through Apple before the end of the current subscription period, in accordance with Apple’s rules. You can manage or cancel a subscription in your Apple subscription settings. Deleting the App does not cancel a subscription.

Purchase restoration depends on a valid Apple transaction, current entitlements, and service verification. Refunds, billing disputes, price changes, and payment failures are handled under Apple’s rules and applicable law; refund requests should be submitted to Apple.

Except where required by law or Apple’s rules, non-use, service quality, destination changes, or early termination does not create an automatic right to a full or prorated refund.

If Apple records and service entitlements appear inconsistent, try restoring purchases and then use an available support channel. To investigate suspected fraud or account-linking issues, we may request a transaction identifier or related account information, but not complete payment-card details.

09

Third-Party Services and External Content

The service depends in part on Apple, the App Store, cloud providers, internet and mobile carriers, relay providers, DNS services, and third-party sites or content. Those services are governed by their own terms, privacy policies, and availability commitments.

We do not control or endorse third-party content and do not guarantee its legality, accuracy, security, availability, or data practices. You are responsible for complying with applicable third-party terms.

10

Intellectual Property and Feedback

The App, service, user interface, text, graphics, trademarks, configurations supplied by us, and related content are owned by us or our licensors and are protected by applicable laws. All rights not expressly granted are reserved.

If you provide suggestions or feedback, we may use them to improve the service without identifying you or owing compensation, subject to applicable law. This does not limit your rights in personal information.

Claims concerning intellectual-property rights may be submitted through an available support channel with sufficient details about the claimed right, the relevant material, its location, and a means of responding to you.

11

Suspension and Termination

You may stop using the service at any time by uninstalling the App and managing any subscription through Apple. Uninstalling does not automatically cancel a subscription or create a refund right.

We may restrict, suspend, or terminate access for a serious or repeated breach, a security risk, nonpayment, suspected fraud, a legal or platform requirement, or another circumstance in which continued access creates material risk. Where reasonably possible, we will provide notice or an opportunity to appeal.

When access ends, the license granted under these Terms ends. Provisions concerning intellectual property, disclaimers, limitations of liability, disputes, and outstanding payment obligations survive to the extent applicable.

12

Disclaimers and Limitation of Liability

To the fullest extent permitted by law, the App and service are provided “as is” and “as available.” We do not promise uninterrupted or error-free operation, absolute security, a particular speed, availability in every region, or access to any specific content, site, destination, or gateway.

To the fullest extent permitted by law, we are not responsible for loss caused by your device or network, third-party services, untrusted or incorrect configurations, events beyond our reasonable control, legal restrictions, or your breach of these Terms.

To the fullest extent permitted by law, neither we nor our service providers will be liable for indirect, incidental, special, punitive, or consequential damages, or for loss of profits, revenue, business, goodwill, data, or opportunity. Nothing in these Terms excludes or limits rights or liabilities that cannot lawfully be excluded or limited, including applicable consumer rights and liability for personal injury where the law so provides.

13

Relationship with Apple

These Terms are between you and us, not Apple. We, not Apple, are responsible for the App and its content.

Apple has no obligation to provide maintenance or support services for the App. If the App fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the App’s purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.

We, not Apple, are responsible for addressing claims relating to the App, including product-liability, legal or regulatory, consumer-protection, privacy, and intellectual-property claims.

Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you after your acceptance. You must comply with the Apple Media Services Terms and Conditions and applicable third-party agreements when using the App.

14

Changes, Governing Law, and Disputes

We may update these Terms to reflect changes in the App, service, business, or applicable law. If a change materially affects your rights, we will provide notice through the App, an update to this page, or another reasonable method. The revised Terms apply after publication. If you do not agree, stop using the service and cancel any subscription through Apple.

These Terms are governed by the law applicable at the service provider’s location, without depriving you of mandatory consumer protections that apply where you live. The parties should first attempt in good faith to resolve a dispute. If it cannot be resolved, either party may bring it before a court or tribunal with jurisdiction under applicable law.

If any provision is unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may transfer them in connection with a merger, reorganization, asset transfer, or service successor, subject to applicable law.

Please read these Terms together with the Jetway Privacy Policy.
